The
May 31 Auction is a unique opportunity to buy property
for a Rural Lifestyle, an Investment in a buyer’s
market or a Retirement property.
1. BIDDER REGISTRATION: All prospective bidders are
to preregister with Adams County Real Estate prior
to the
auction. Preregistration prior to the auction is necessary
in order to bid. Your name, address (including street
name) and phone number, (optional) email address are
to be submitted either in person, by telephone, by
mail or email to Adams County Real Estate, 208-253-4888,
glemser@ctcweb.net,
or 100 Mosher, P. O. Box M, Council, Idaho, 8312. Bidders
will receive a bidding number to use during the auction.
The successful bidder will be required to sign an Earnest
Money Agreement and place $10,000 Earnest Money with
the local title company on the day of the auction.
Earnest Money is to be in the form of a pre-approved
check, cashier’s
check or letter of credit from a bank. A successful
bid at auction constitutes a legally binding contract
of
sale.
2. BIDDING ABSENTEE: A registered bidder may bid absentee
if he has left bidding instructions with Adams County Real
Estate and deposited Earnest Money of $10,000.00 with Timberline
Title and Escrow. The bidder will also be required to complete
an earnest money agreement to become effective on the day
of bidding if the bidder becomes the highest bid. An absentee
bidder is highly encouraged to take an opportunity to preview
the property prior to the auction.
3. BIDDING: Bidding starts at 11:00 for small items and
the Real Estate Auction will begin at 12:00 P.M. Saturday,
May 31. All bidders are to pre-register prior to auction.
4. BROKER PARTICIPATION: A commission of 3% of the final
bid will be paid to licensed Real Estate Agent or Broker
whose buyer wins the bid and closes escrow on the auction
property. To qualify for the commission, the licensed agent
must register and accompany their client while inspecting
the property. All registration of buyers by an agent is
to be received and acknowledged by noon May 28, 2008.
5. BUYER’S PREMIUM: A 5% Buyer’s
Premium will be added to the final bid in order to
determine
the final
contract price.
6. CLOSING: Closing will take place within 30 days after
the auction.
7. CONTINGENCIES: There will be no contingencies on the
earnest money agreement.
8. FAILURE TO CLOSE: If for any reason you are unable
to complete the contract of sale your earnest money deposit
will be forfeited.

lenders are familiar with the real estate auction and
property and would be glad to lend their assistance.
10. PROPERTY INSPECTION:
It is highly recommended that a buyer preview the properties.
The
property is being
sold in “AS IS condition.” Call Fred Glemser

time.
11. PURCHASE CONTRACT:
The highest bidder receives the right and obligation
to become the purchaser
of the property.
A Real Estate Purchase and Sale Agreement will be completed
on the day of the auction. Buyer will also pay ½ of
the closing costs associated with the transaction.
12. SELLER’S and AUCTIONEER’S
DISCLAIMER: All announcements made by auctioneer
shall take precedence
over any previously written material or oral statements
made. Conduct of the auction, increments of the bidding
and decisions as to the high bidder will be at the direction
and sole discretion of the Auctioneer. All information
on properties is deemed to be reliable, with no liability
for accuracy, errors, or omissions is assumed by seller
or their agents. All auction properties are available
for and subject to prior sale up to the date of the auction.
13. TITLE INSURANCE:
Title Insurance will be supplied and paid for by the
Seller, giving Buyer clear and marketable
title subject to restrictions of record at close of escrow.
Timberline Title and Escrow will act as the Escrow Agent
and provide title insurance. Closing will take place
